PRIVACY POLICY

1. IDENTITY OF SONAK

1.1. "SONAK" or "we" refers to SONAK ASIA PTE. LTD., a company incorporated and registered in Singapore. We have our branch office address here in the Philippines at the 30th Floor, Parkway Corporate Center, Corporate Ave. corner Parkway Place, Filinvest City, Alabang, Muntinlupa City 1781.

1.2. Under the terms of the Master Service Agreement that we entered into with ABC-Mart Sonak Philippines Inc. (“ASP”), we are vested with the authority to offer and sell ASP Products (“Products”) via digital and e-commerce platforms.

2. APPLICABILITY

2.1. This Privacy Policy details the types of information that SONAK collects, the user or viewer’s options about such information, and how SONAK uses, shares, updates, and secures such information, in accordance with the Philippine Data Privacy Act of 2012 (the “Data Privacy Act”). This Policy applies to information obtained in connection with SONAK’s operations through its Website, social media presence, emails, marketing campaigns, digital and online advertising.

2.2. All individuals and Customers who use or access this Website, regardless of whether a purchase was made (“Customer” or “you”), shall be deemed to have accepted and are bound by the provisions of this Privacy Policy.

3. CLASSIFICATION OF PERSONAL INFORMATION COLLECTED

3.1. SONAK collects Personal Information including name, mailing address, email, date of birth, credit/debit card information, telephone/cellphone number, and other information identifying the individual.

3.2. Personal Information is collected through:

  • a. Information Provided by the Customer:
    • Creating an account
    • Making a purchase
    • Contacting SONAK for customer support
    • Participating in surveys, sweepstakes, or promotions
    • Subscribing to emails or other communications
    • Downloading website content
    • Filing claims or participating in investigations
    • Other communications with SONAK
  • b. Information from Third Parties: SONAK may receive information from third-party sources, including analytics and feedback services such as Google Analytics, to improve the Website and marketing efforts.
  • c. Passively Collected Information: Collected via Cookies and similar technologies, including IP address, device type, OS, browser, screen resolution, location, search terms, and website interactions.
  • d. Social Media: Interaction through social media platforms (Facebook, Instagram, Twitter, TikTok) may result in collection of Personal Information, including login credentials and account activity. Information is also subject to each platform’s privacy policy.

4. CUSTOMER OPTIONS

  • 4.1. Unsubscribe: Customers may unsubscribe from marketing communications via privacy.saph@sonak.com.ph with the subject “PERSONAL DATA.” Processing takes 30 calendar days. Transactional communications may still occur.
  • 4.2. Disabling Cookies: Customers may access the Website without certain cookies or tracking tools, though functionality may be limited.
  • 4.3. Location Details: Customers can restrict collection of specific location data via browser/device settings, though general IP-based location may still be used.
  • 4.4. Request for Deletion of Personal Records: Customers may request deletion by emailing privacy.saph@sonak.com.ph when SONAK no longer has a legitimate reason to retain the data.

5. SHARING OF CUSTOMER PERSONAL INFORMATION

5.1. SONAK may share Personal Information with affiliates, partners, and authorized service providers for legitimate purposes.

5.2. Information will not be shared with unaffiliated third parties without consent, unless required by law.

5.3. SONAK may specifically share information for:

  • Providing products/services to affiliates, subsidiaries, and partners
  • Shipping and payment processing
  • Compliance with legal and regulatory requirements

5.4. Personal Information in connection with Loyalty Programs (ABClub) may be shared with SFSC and Capillary for secure processing.

5.5. All sharing is confidential and subject to the Data Privacy Act of 2012.

6. PURPOSE OF COLLECTION AND USE OF CUSTOMER PERSONAL INFORMATION

6.1. Customer information is collected to:

  • Deliver orders and communicate with Customers
  • Support loyalty programs (ABClub)
  • Process payments and returns
  • Conduct surveys, contests, or promotions
  • Register Customer Accounts
  • Provide customer service
  • Conduct research and analysis
  • Inform Customers about products and promotions
  • Enhance products, Website, and social media accounts
  • Promote SONAK and partner products
  • Protect website security
  • Other disclosed purposes

6.2. Information may also be processed to combine online/offline data, retain for up to 2 years, and monitor marketing effectiveness.

7. SECURITY

SONAK implements security measures to safeguard Personal Information, including encryption and restricted access protocols for accounts and passwords.

8. DATA BREACH

  • 8.1. Customers hold SONAK harmless for breaches in third-party databases unless caused by SONAK’s gross negligence, willful misconduct, or bad faith.
  • 8.2. For breaches in SONAK’s own database, Customers will be notified promptly. SONAK will mitigate damages, with liability limited to gross negligence or bad faith.
  • 8.3. SONAK is not liable for indirect, incidental, or consequential damages from breaches.
  • 8.4. Liability for damages is limited to the transaction amounts within the past 12 months.

9. PERSONAL INFORMATION OF MINORS AND INDIVIDUALS INCAPABLE OF CONSENT

SONAK does not knowingly collect Personal Information from children under 18 or individuals incapable of consent without parental/legal guardian approval. Parents/guardians may contact privacy.saph@sonak.com.ph to request action.

10. THIRD-PARTY LINKS

Links to external websites or advertisements are not under SONAK’s control. Customers are encouraged to review third-party privacy policies. SONAK is not responsible for third-party data handling practices.

11. CUSTOMER’S ACCESS TO PERSONAL INFORMATION

Under the Data Privacy Act, Customers may request access, correction, objection, portability, erasure, or file complaints regarding Personal Information. Contact privacy.saph@sonak.com.ph for assistance.

12. UPDATES

SONAK may update this Privacy Policy from time to time. Customers are encouraged to review it periodically. Material changes affecting rights or use of Personal Information will be notified at least 30 days prior to the effective date. Customers who disagree with changes may discontinue use or request account cancellation by contacting privacy.saph@sonak.com.ph.
